A Glendale police officer being investigated in connection to a fatal shooting of an unarmed man posted an insensitive photo on social media, lamenting his confinement to desk duty while the shooting probe is ongoing.

Glendale police Officer Chandler Phillips posted this photo on social media.

The post, which has since been taken down, was a photo of Officer Chandler Phillips pouting with a caption reading, “Stuck on Desk Duty :[.” It also featured a scene the 2010 movie, “The Other Guys,” with actor Mark Wahlberg quoting, “I’m a peacock, you gotta let me fly!”

Phillips and another Glendale officer are being investigated for the Oct. 31 shooting of 36-year-old John Pacheaco Jr. on Colorado Boulevard. Pacheaco was unarmed inside a pickup truck at the time of the shooting.

Brian Maass, of KCNC-TV, Channel 4, reported the social media posting Friday.

“This shooting and the corresponding social media post published by the shooter, a deputized Glendale Police Department officer, is disturbing and outrageous,” said Matthew A. Haltzman, an attorney representing Pacheaco’s family, including his mother, Jamie Fowler, of Utah.

Fowler has been deeply disturbed by the shooting and the social media post added to her misery, Haltzman said Wednesday.

“The fact that this Mr. Phillips and another officer shot her son multiple times in the face, neck, chest and arm and took her son’s life is apparently lost on him, if this is what he is posting on his social media account,” Haltzman said.

Glendale police were unaware of the post until a news organization brought it to their attention last week.

“We are not comfortable with the photo or the captions and they are in poor taste to say the least,” said Lt. Jamie Dillon in a written statement. “The Pacheaco family has suffered a tremendous loss and the situation should not be made light of in any way.”

Police ordered Phillips to take down the post last week, and the department apologized for it.

Attorney Danny Foster, who represents Phillips, said that his client is remorseful about the posting.

“Officer Phillips understands how insensitive this post was,” according to Foster’s written statement. “He never intended to make a joke of this incident. He is deeply sorry for this indiscretion. The post has been removed and Officer Phillips is committed to being more thoughtful in the future.”

Phillips remains with the department on desk duty. An investigation by Denver police into the shooting is ongoing. Phillips faces an internal Glendale police investigation into the posting after the shooting probe wraps up.
